Agenda IDS – “Key topics on compulsory patent licenses: BRICS perspective”

The Dannemann Siemsen Institute (IDS) invites experts to discuss key issues related to compulsory patent licensing from a BRICS perspective, with a particular focus on Brazil, India, and China.

Join us for a strategic conversation on how these economies implement the compulsory patent licensing flexibilities provided under the TRIPS Agreement and incorporated into their national IP laws—particularly in the context of pharmaceutical patents. The discussion will address the challenges these countries face in balancing public interest, innovation, industrial policy, and international commitments.

Ana Claudia Mamede Carneiro, partner at Dannemann Siemsen and member of the IDS Advisory Board, will share insights from the Brazilian perspective and moderate the roundtable discussion featuring three experts on the topic:

  • Ms. Mamta Rani Jha will present the Indian approach to patent compulsory licensing.
  • Dr. Ning JIANG and Mr. Butian MA will explore how the topic is addressed within the Chinese legal framework.

Speakers:

Mamta Rani Jha

Co-managing Partner at Inttl Advocare, leads the firm’s litigation and opposition practice, bringing over 25 years of extensive experience in Intellectual Property Law. B.Sc. Zoology (Gold Medalist), Mamta has built a reputation for her exceptional expertise in patents, trademarks, designs, copyrights, and emerging technologies, including AI, NFTs, and blockchain. She has represented top global companies across a wide range of industries in over 500 landmark IP cases, especially representing leading global pharmaceutical companies in patent litigation.

Dr. Ning JIANG

Patent Attorney at China Patent Agent (H.K.) Ltd. She has a bachelor’s degree in Material Science and Engineering from Northwestern Polytechnical University (2010) and a PhD in Material Science and Engineering from Tsing Hua University (2015). Dr. Jiang’s practice includes domestic and international patent law covering patent application, administration, and litigation. She mainly focuses on industrial designs and patents in the technical field of mechanics, including manufacturing & industrials, automotive, healthcare tech, clean energy & advanced materials, among others.

Mr. Butian MA

Attorney-at-law and patent attorney at China Patent Agent (H.K.) Ltd.  Mr. Ma has a bachelor’s degree of Engineering in measurement and control technology and instrumentation from Beijing Jiaotong University (2011), a master’s degree in science in electronic and electrical engineering from the University of Sheffield in the UK (2013), and a master’s degree of intellectual property from University of New Hampshire School of Law in the US (2014). He also passed the USPTO registration examination in the United States. His practice includes domestic and international patent law covering patent application, administration, enforcement, and litigation. He is also skillful in patent drafting, patent prosecution, and reexamination in CNIPA, USPTO, and EPO.

Moderator

Ana Claudia Mamede Carneiro

Partner at Dannemann Siemsen, bachelor’s in chemical engineering from the Rio de Janeiro Federal University (UFRJ) and a postgraduate degree in Quality Engineering from São Paulo University (USP). She works with patent issues in the fields of Chemistry, Pharmacy and Biotechnology in the administrative and judicial spheres, as well as in matters related to Access to Genetic Resources, Associated Traditional Knowledge and Benefit Sharing.
