New action plan (2023-2025) for the National Intellectual Property Strategy is released
The 2023-2025 Action Plan of the National Intellectual Property Strategy (ENPI) was released last Tuesday. The document aims to ensure progress towards an intellectual property (IP) system capable of leveraging Brazil’s competitiveness and economic and social development.
The plan, drawn up by the Brazilian Inter-ministerial Group on Intellectual Property (GIPI), incorporated suggestions from civil society, provided through the taking of subsidies. The strategy encompasses 63 actions and 161 deliverables distributed across seven areas of action, including measures to: speed up the time it takes to decide on patent applications; raise Brazil’s ranking in trademark and industrial design registrations; and increase the number of innovation projects benefiting from Intellectual Property (IP) mentoring.
One of the measures highlighted is the reduction in the time it takes to decide on patent applications from 6.9 years, by December 2022, to 3 years by July 2025. This target, considered intermediate, reflects the expectation of the National Institute of Industrial Property (INPI) to speed up processes, with projections of a reduction to 2 years by 2026 (through complementary actions).
In addition, the plan seeks to encourage the practical application of patents in the industrial sector, promoting the transfer of technology, given that more than half of the country’s patent filings come from universities, but not all of them are converted into advances for industry. To this end, various educational initiatives are also planned to disseminate the IP culture at different levels of education, including a program to reward teachers who promote this knowledge among students. Lectures and workshops on strategic IP issues will also be given to INPI examiners and magistrates.
The strategy also provides for the creation of an IP intelligence center, responsible for studies that contribute to identifying: technological capacities and trends; new forms of appropriation of creations protected by IPR; and means to stimulate the use of databases to support innovation and the creative economy.
