IDS debates important issues in strategic litigation management
Last Thursday (6), the Dannemann Siemsen Institute (IDS) organized another IDS Agenda, this time with the aim of debating relevant issues involving strategic litigation management. Among the topics debated, the panel discussed: the routine, dynamics and challenges faced by companies‘ strategic legal departments; what these departments expect from their partner law firms with regard to joint action on companies’ strategic legal and advisory demands, among others.
The event was opened by IDS academic coordinator Patrícia Porto and moderated by IDS board member and Dannemann Siemsen partner Rodrigo de Assis Torres. As guests, we welcomed Andrezza Donini Campos, a lawyer who has managed Claro S.A.’s strategic civil department for more than 14 years, who spoke about the issue from the perspective of companies in the telecommunications sector; and Camilla Ygesca, the lawyer responsible for civil and criminal claims for Cargill Agrícola in Brazil, who brought the perspective of companies focused on agribusiness.
The debate began with Rodrigo de Assis explaining the need to structure companies’ legal departments to deal with legal claims. Andrezza Donini began her speech by explaining that in-house legal departments should act as facilitators, translating the law into a specific business plan. She also said that, in her view, in recent years there has been a change in the profile of these departments, which are now seen as effective partners of companies, with speaking slots, and are therefore considered to be an effective part of the machinery.
Camilla Ygesca then gave her perspective on the subject. According to her, the legal departments of companies have taken on the role of counsellors, and it is sometimes more advantageous for strategic litigation not to litigate in certain cases. Camilla also noted in this context that the work must take into account the impact of a case on a particular company, making a preventive and corrective analysis of litigation.
Later on, the speakers talked about their daily practices, their difficulties and the types of claims they deal with on a daily basis. Here, Andrezza Donini explained that legal departments in strategic litigation don’t just deal with lawsuits, but are also important for providing consultancy, thinking of different solutions to the problems presented. Camilla Ygesca also pointed out that professionals working in this area need to be dynamic, with a broad and multidisciplinary vision, building bridges of dialogue with all areas of the company.
