European Commission’s counterfeit and piracy watch list

The European Commission published, on December 1st, the third edition of the “Counterfeit and Piracy Watch List”. The Watch List reflects the results of a public consultation made between December 15th, 2021 and February 14th, 2022, where the Commission invited stakeholders to share their views.

The Watch List aims to provide significant examples of different types of online service providers and physical markets that play, directly or indirectly, a major role in the counterfeiting or piracy of Europe Union (EU) intellectual property rights protected goods and content outside the EU. The document focus are websites providing copyright-protected content, e-commerce platforms, online pharmacies, and physical markets. The list also intends to raise consumer awareness concerning the environmental, product safety and other risks of purchasing from potentially problematic marketplaces.

The monitored physical and online marketplaces and services in the list are located or can be accessed, mainly, in China, Southeast Asia and Latin-America countries. Brazil was one of the countries reported.

In terms of websites services that operates in Brazil, the download service Snappea.com was indicated as a fast-growing stream ripping service that allows users to obtain a copy of a YouTube video or ‘rip’ audio from the video. This online service was the subject of a criminal lawsuit in São Paulo and, within the scope of this action, a decision issued a permanent blocking order against this online service websites. Others three websites that were subjects of judicial blocking orders in Brazil are you2mate.com, Flvto.biz and 2conv.com.

Regarding physical marketplaces and the regions where they are located, the following were identified as problematic in Brazil: the markets in the Rua 25 de Março and in Brás area, the both places in São Paulo; the city of Nova Serrana in Minas Gerais State, that is reported as a major production site for counterfeit sport shoes, distributed in Brazil and other Latin American countries; the Feirão das Malhas market in Rio de Janeiro; and the Feira de Importados market, located in Brasilia.
