The article reviews the patent protection process in Brazil and shows that there are clear signs that this new regime will steadily reduce the backlog of patent examinations in the coming years.
IDS Board Member Bernardo Marinho Fontes Alexandre and Dannemann Siemsen’s office partner Gustavo de Freitas article on Dispatches 6.21 and 6.22 that promise to end the patent backlog was published on darts-ip.com and shows how the process of obtaining patent protection in Brazil has been reduced over the years. With the creation by INPI of the simplified process through Resolutions 240/2019 and 241/2019, there are clear signs that this new regime will steadily reduce the backlog of patent examinations in the coming years. This improvement appears to be feasible as examiners will rely more extensively on research reports and opinions issued by foreign IP offices.
