BPTO releases IP Bulletin with overview of applications and grants in 2024

On January 8, the Brazilian Patent and Trademark Office (BPTO) published its Monthly Industrial Property Bulletin, a statistical report that analyzes applications and grants of Industrial Property (IP) rights, as well as examining the countries of origin of the applications and the legal nature of the applicants. The edition presents both a quarterly and annual diagnosis, highlighting, especially in 2024, the growing demand for trademark registrations.

According to the bulletin, in 2024 there was an increase in the number of trademark applications (+10.3%), totaling 444,037 applications, as well as an increase in applications for industrial designs (+3.1%), computer programs (+25.5%) and topographies of integrated circuits, with six applications in 2024 compared to just one the previous year (+500%). On the other hand, there was a reduction in patent application filings (-0.8%), which totaled 27,701 filings in 2024, as well as a drop in requests for the registration of technology contracts (-22.5%) and the registration of geographical indications (-3.7%).

With regard to concessions, the report points to a downward trend in almost all areas. The balance sheet for 2024 shows a reduction of -32.8% in patent grants, with 12,914 patents granted, compared to 19,204 grants in 2023. In the case of trademarks, the reduction was -21.3%, with 166,063 registrations made, in contrast to the 210,987 trademarks registered the previous year. For industrial designs, the drop was -14.0%, totaling 4,093 grants. There was also a decrease in computer program registrations (-8.9%) and in technology contract registrations (-27.2%). However, in the field of geographical indications, 16 were registered in 2024, an increase of six compared to 2023. As for integrated circuit topographies, six were granted, five more than in the previous year.

The document also analyzes the profile of applicants by country of origin and legal nature. In 2024, the United States led the way in invention patent applications (28%), followed by Brazil (23%), China (8%), Germany (6%) and Switzerland (4%). With regard to utility model, trademark, industrial design and technology contract filings, most were made by Brazilian applicants. For trademarks and industrial designs, national filings accounted for 96% and 79% of the total, respectively.

Finally, the bulletin presented statistics on the legal nature of resident applicants. In the field of invention patents, individuals accounted for 33% of the 5,740 applications made by residents, followed by teaching, research and government institutes (28%) and medium and large companies (26%). In utility model patents, individuals accounted for 58% of total filings. As for trademarks, the largest applicants were sole micro-entrepreneur, micro-enterprises and small companies (50%), followed by individuals (29%) and medium and large companies (18%). For industrial designs, there was a balance in filings by individuals (30%), medium and large companies (35%) and sole micro-entrepreneur, micro companies and small businesses (31%).
