Beyoncé secures brand rights for her daughter’s name Blue Ivy

The singer Beyoncé recently won the TTAB – Trademark Trial and Appeal Board, which granted her rights to the brand name of her eight-year-old daughter Blue Ivy Carter. The success was due to the wedding organizer Wendy Morales, whose company was called Blue Ivy Events, which was registered by the USPTO (US Patent and Trademark Office) before 2012, the year of the singer’s daughter’s birth.

At the time, Beyoncé and Jay-Z applied for the registration of their daughter’s name with the USPTO in 14 different classes of products such as cosmetics, baby items, hair accessories, video games, books, among others. Morales presented a “notice of opposition” to TTAB with the argument that the eventual granting could confuse the consuming public, and that there would be an absence of intentionality by the applicant for the use of the mark for commercial purposes, with the sole purpose of preventing the use by third parties.

TTAB positioned itself favorably to the singer, arguing that there would be no evidence that the two brands could confuse the consumer. Furthermore, it would not be unlikely that artists would use the brand to create products, since Blue Ivy is already a public figure known worldwide for the fame of his parents, having contributed to songs, award-winning films and advertising campaigns.
