ANPD releases its second Monitoring Cycle Report
On December 8, the National Data Protection Authority (ANPD) published its second Monitoring Cycle Report (RCM) of the General Supervision Coordination (CGF), referring to the activities of the first half of 2023. The document analyzes compliance with the ANPD’s guidance, preventive and repressive enforcement strategies during the period under review.
According to the document, from January to June this year, the CGF received 496 Requests, once complaints of violations of the General Personal Data Protection Law (LGPD) and petitions from data subjects (a request from a data subject to exercise their rights in relation to the processing of their data) are added together. It is important to note that most of the requests are linked to public administration, telecommunications, digital platforms, banks, financial institutions and data aggregators.
In addition, the RCM provides information on other activities carried out by the ANPD, including requests, inspection processes and Security Incident Communications (SIC). On this point, it reports that there were 163 CIS, mostly caused by ramsomware (data hijacking). In addition, 2 inspection cases were opened and of the 11 inspection cases opened in previous years, 4 have already been concluded.
The report, like its predecessor, reflects both the progress made in 2023 and the strategic projections to guide, together with the Priority Themes Map, the ANPD’s enforcement actions in the next monitoring cycle (July to December 2023).
