ANPD publishes Technical Note on the Safe Stadium Project, which aims to introduce recognition technologies to Brazilian stadiums
Recently (November 10), the ANPD published a new technical note, this time with guidelines on the “Safe Stadium Project”. The project, which is the result of a cooperation agreement between the Ministry of Justice and Public Security (MJSP) and the Brazilian Football Confederation (CBF), has as its main objective “the fight against racism and violence in Brazilian stadiums, by applying the use of technologies that make it possible to identify fans who have been involved in illegal activities and may cause problems in sports venues”.
With this in mind, the ANPD published a technical note with a view to analyzing the bill with regard to the sharing and processing of fans’ personal data. The authority examined points such as meeting the public interest; compliance with the principles set out in art. 6 of the General Data Protection Law (LGPD); the hypotheses of data sharing; the availability of established and standardized mechanisms and procedures; the appointment of the responsible data protection officers, among others.
Among the observations made, it is worth highlighting the obligation to ensure that the places where tickets are sold, as well as parking lots and around stadiums where there are cameras, have written information that personal data will be shared with the MJSP. The authority also clarified that the body must inform the MJSP that only the data of persons of interest will be passed on, that personal data will be deleted after the end of the sporting event, and that there will be no sharing of data in real time and with images.
Finally, the ANPD’s General Inspection Coordination (CGF) made some recommendations to both the MJSP and the CBF about the Safe Stadium project. For example, the need to constantly assess the risks, both cybernetic and to fundamental rights. Also, that the MJSP should legally justify the creation and periodic updating of a national database relating to the data of people whose access is prevented in stadiums, part of the project’s initiative.
