Webinar: “Intellectual Property and Internet: the civil liability of Internet providers for damages arising from content generated by third parties”

The Dannemann Siemsen Institute (IDS) held a free webinar on the civil liability of Internet access providers on August 19th at 11:00 am.

Law nº 12.965/2014, known as Civil Law of the Internet, establishes principles, guarantees, rights and duties for the use of the Internet in Brazil and determines the guidelines for the performance of public entities in relation to the matter. One of the most relevant and controversial issues dealt with by the law is the civil liability of Internet access providers. While its article 18 provides that the provider will not be held civilly liable for damages arising from content generated by third parties, the caput of article 19 establishes that the provider may be held liable if, after a specific court order, it does not take measures to, within the scope and within the technical limits of its service and within the period determined in the court order, make the content identified as infringing unavailable.

Despite the clarity of these provisions, there are also other issues that deserve to be debated and better reflected, especially in relation to the balance of the various rights and interests involved, such as the effective protection of Intellectual Property Rights on the Internet.

For this event, we invited specialists in the field to debate the subject, present their experiences and present their arguments in favor or against the current legislation.
