Agenda IDS – “Relevant Issues on Patent Application Division”

Agenda IDS 2023: The Dannemann Siemsen Institute hosted a team of experts to discuss relevant issues regarding the division of patent applications.

The possibility of dividing a patent application is essential for it to comply with legal requirements and be granted. This procedure is allowed by Article 26 of Law 9279/96, the Industrial Property Law, provided certain requirements are met, including time limits for its submission.

This is a topic that raises significant discussions, such as:

• The relevance of the patent application division procedure for encouraging innovation.

• The scope and extent of the patent application division request, as well as the deadline for submitting this request.

• How INPI (Brazil’s National Institute of Industrial Property) and the Courts treat this matter.

Under the moderation of Institute Counselor Mauricio Teixeira Desiderio, IDS has invited a group of experts to discuss these and other important topics related to this theme:

• Federal Judge Wanderley Sanan Dantas discussed, among other things, how the Judiciary has been addressing issues related to patent application division.

• Janaína Tomazoni Santos, from EMBRAPA, debated the subject from the perspective of patent holders.

• Bernardo Marinho Fontes Alexandre, partner at Dannemann Siemsen, addressed the advantages and challenges of this procedure from a technical point of view.
