Brazil and India sign a memorandum for cooperation in intellectual property
On July 9, 2025, the Department for the Promotion of Industry and Domestic Trade, of India, and the Secretariat of Competitiveness and Regulatory Affairs, of Brazil, signed a five-year Memorandum of Understanding (MoU) in the field of Intellectual Property (IP). The objective of the document is to promote the exchange of experiences to strengthen the IP systems of Brazil and India, in addition to fostering innovation, creativity and technological development.
Among the activities foreseen in the MoU, cooperation in the development of automation projects and modernization of documentation and information systems in IP stand out, as well as the exchange of databases related to traditional knowledge. The agreement also mentions the exchange of information and best practices on patent applications, trademarks, industrial designs and geographical indications, as well as the protection and management of IP.
The document then establishes that the implementation, monitoring and evaluation of the activities provided for in it will be carried out by two responsible coordinators, to be appointed by each party. In addition, with regard to financial resources, Brazil and India will be responsible for the expenses of their own employees involved in the activities arising from the MoU, including any travel and per diem costs.
Finally, the agreement clarifies that all cooperation activities must be in accordance with the respective jurisdictions of each country, and that no employment relationships will be created between India and the officials designated by Brazil, and vice versa. If necessary, the competent authorities of both parties will facilitate the movement and permanence between the two countries of the individuals involved in the cooperation projects provided for in the document.
