IDS Agenda – “Technical evidence: proving high brand reputation and market research in IP lawsuits”

IDS Agenda 2024: the Dannemann Siemsen Institute (IDS) is hosting a team of experts to talk about the production of technical evidence in the area of intellectual property (IP), in particular, research to prove the high reputation of a trademark in Brazil and market research in the context of IP lawsuits.

The aim of this event is to debate relevant issues on the subject, such as: which surveys are suitable for proving the high reputation of a trademark; what needs to be observed in relation to the preparation and application of these surveys; what requirements are necessary; the concept and relevance of market surveys as technical evidence; what requirements and elements are essential for preparing a market survey as technical evidence, among other issues.

To discuss these and other points, Dannemann Siemsen Institute advisor Roberta de Magalhães Fonteles Cabral will moderate a panel with two experts on the subject:

Prof. Dr. Gustavo Cesário will discuss important aspects of research to prove the high reputation of a trademark;

Prof. Dr. Kone Prieto Furtunato Cesário will talk about market research as technical evidence in the context of IP lawsuits.

SPEAKERS:

Prof. Dr. Kone Prieto Furtunato Cesário is a professor of Commercial Law and Intellectual Property at the Federal University of Rio de Janeiro (FND/UFRJ); and a professor at the INPI Academy, teaching in the master’s and doctoral courses. Kone holds a doctorate and a master’s degree in law from PUC-SP; she was vice-director of FND/UFRJ in 2017-2021.

Prof. Dr. Gustavo Cesário is a professor of Branding, Intellectual Property and Marketing on ESPM’s Executive Education courses; a guest professor at EMERJ on the Intellectual Property extension course and on ABAPI’s forensics course. Gustavo holds a doctorate in Business Administration from FGV/EBAPE, a master’s degree in Business Administration from FGV/EAESP and a bachelor’s degree in Advertising and Marketing from ESPM-SP.
