The Ministry of Health (“MoH”) published on the Official Gazette of January 27, 2017, and republished on January 30, 2017, the Ordinance No. 252\/2017 (“Ordinance 252”), which details the strategic products for the Brazilian Universal System of Health – SUS for the year of 2017.<\/p>\n

MoH has divided the lists of strategic products in two appendixes: (i) Appendix I establishes the strategic products which are eligible for Product Development Partnerships (“PDP”) in 2017, and (ii) Appendix II lists the strategic products which are already subject of an ongoing PDP or of another sort of technology transfer to MoH and therefore are not eligible for PDP in 2017.<\/p>\n

Considering that MoH Ordinance No. 2.531\/2014, which regulates the submission and approval of PDP, is still in force, we understand that the deadline for any interested part to present a PDP proposal involving the products listed Appendix I is April 30, 2017, as provided by Article 13.<\/p>\n
