{"id":3176,"date":"2012-12-27T00:00:00","date_gmt":"2012-12-27T05:00:00","guid":{"rendered":"https:\/\/ids.org.br\/novo-site\/en\/cyberpirate-wrecks-in-brazil\/"},"modified":"2020-01-15T16:30:10","modified_gmt":"2020-01-15T21:30:10","slug":"cyberpirate-wrecks-in-brazil","status":"publish","type":"post","link":"https:\/\/ids.org.br\/en\/cyberpirate-wrecks-in-brazil\/","title":{"rendered":"Cyberpirate wrecks in Brazil"},"content":{"rendered":"<p style=\"text-align: justify\"><span style=\"color: #505050\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">After 10 years of a judicial dispute, Brazilian animation fans may now rejoice, as the domain name <\/span><\/span><\/span><span style=\"color: #505050\"><a href=\"https:\/\/www.nick.com.br\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">www.nick.com.br<\/span><\/span><\/a><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\"> has finally been recovered by its true owner: the famous TV channel NICKELODEON, a.k.a NICK.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #505050\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">During the last decade, VIACOM had to adapt&nbsp;&nbsp; itself to the harder-to-access address <\/span><\/span><\/span><span style=\"color: #505050\"><a href=\"https:\/\/www.mundonick.com.br\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">www.mundonick.com.br<\/span><\/span><\/a><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">, to permit its public to communicate with their famous and beloved characters.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #505050\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">The decision rendered by the Court of Appeals of the State of Minas Gerais calls for attention in two main aspects.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #505050\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">In addition to recognizing trademark rights on decisions involving domain names, particularly when relating to famous expressions, it acknowledged special rights derived from what the doctrine calls &ldquo;family of trademarks&rdquo;. <\/span><\/span><\/span><\/p>\n<p><span style=\"color: #505050\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">According to the Court&rsquo;s decision, the existence of a family of trademarks should be afforded special protection, as confusion as to source or sponsorship would be more likely to occur under such circumstances. In the action, Viacom proved ownership, in Brazil, over several trademark registrations composed by NICK as their central element, so that the public would be more easily misled by Defendant&rsquo;s use of the domain name. <\/span><\/span><\/span><\/p>\n<p><span style=\"color: #505050\"><span style=\"font-size: x-small\"><span style=\"font-family: Verdana\">According to the Reporter Judge: &ldquo;the domain name is its digital identity, it is how the business will be known and, more importantly, how it will be recognized in the Internet.
